Overview
This website is operated by CALIBR. Throughout the Site, the terms “we”, “us” and “our” refer to CALIBR.
CALIBR is operated by First Kill Ltd, a company registered in New Zealand.
CALIBR provides this website, including all information, tools, products and services available through the Site, subject to these Terms of Service.
By visiting our Site, purchasing from us or otherwise using our Services, you agree to these Terms of Service together with any policies referred to in them, including our Privacy Policy and Returns & Refund Policy.
Please read these Terms carefully before using the Site.
Nothing in these Terms excludes, restricts or limits any consumer right or remedy that cannot legally be excluded under applicable law.
Our business practices are subject to applicable New Zealand consumer law, including the Fair Trading Act 1986 and Consumer Guarantees Act 1993. The Fair Trading Act includes protections relating to misleading conduct and unfair consumer contract terms.
Where mandatory United Kingdom consumer law applies to a purchase made by a UK consumer, nothing in these Terms is intended to exclude or restrict those rights. UK consumer law provides statutory rights relating to the quality and description of goods and remedies where those rights are breached.
Our online contracting and electronic communications are also subject to applicable provisions of the New Zealand Contract and Commercial Law Act 2017, including Part 4 relating to electronic transactions.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and Services to you.
1. Online Store Terms
By using our Services, you confirm that you have legal capacity to enter into a contract or that you are using the Services with any consent required under the laws applicable to you.
You may not use our products or Services for any unlawful or unauthorised purpose.
You must not attempt to introduce viruses, malicious code or other material that could interfere with the operation or security of our Site or Services.
A serious breach of these Terms may result in your access to the Services being suspended or terminated.
2. General Conditions
We reserve the right to refuse or cancel service or an order where we have a legitimate reason to do so, including suspected fraud, payment problems, product unavailability, abuse of our Services or an obvious pricing or listing error.
Nothing in this section permits us to discriminate unlawfully or avoid obligations imposed by applicable consumer law.
You may not reproduce, duplicate, copy, sell, resell or exploit any substantial part of the Site or Services without our written permission, except where permitted by law.
3. Accuracy of Information
We make reasonable efforts to ensure that information on our Site is accurate and current.
Occasionally information may contain errors or become outdated. We may correct or update information where appropriate.
Nothing in this section limits our responsibility under applicable consumer law for descriptions, representations or other information that forms part of a consumer transaction.
4. Prices and Changes to the Services
Product prices may change from time to time.
A price change does not affect an order that we have already accepted unless an obvious error has occurred and applicable law permits us to correct or cancel the transaction.
We may modify, suspend or discontinue products or parts of the Site where reasonably necessary.
5. Products
Certain products may be available exclusively online and may be produced or stocked in limited quantities.
Products are subject to our Returns & Refund Policy and your statutory consumer rights.
We make reasonable efforts to display product colours, finishes, textures, sizes and other characteristics accurately. However, the appearance of products can vary depending on factors such as screen settings and lighting.
Where our products are handmade or individually finished, reasonable variations may occur between individual pieces.
Such variations do not affect any statutory rights you may have where goods are faulty, damaged, incorrectly supplied or materially different from their description.
We may limit the quantities of particular products available for purchase where reasonably necessary.
6. Orders, Billing and Account Information
You agree to provide accurate and current information when placing an order.
We may cancel or limit orders where reasonably necessary, including where:
- payment cannot be processed;
- an item is unavailable;
- we identify an obvious error;
- we reasonably suspect fraud or misuse;
- unusually large quantities appear to be intended for unauthorised resale; or
- we are legally unable to fulfil the order.
Where an order is cancelled after payment has been taken, we will provide the appropriate refund.
We may contact you using the email address, telephone number, billing address or other contact details supplied with your order.
7. Customer Accounts
Some Site features may allow or require you to access a customer account.
You are responsible for keeping access codes and other account credentials secure.
Please contact us promptly if you believe your account has been accessed without authorisation.
8. Optional and Third-Party Tools
We may provide access to third-party services or tools.
Third-party providers may have their own terms and privacy policies, and your use of those services may be governed by those terms.
We are not responsible for independent third-party services except to the extent that applicable law provides otherwise.

We do not control third-party websites and are not responsible for their content, privacy practices or independent services.
You should review the terms and privacy information of a third-party service before using it.
10. Reviews, Feedback and User Content
If you submit a product review, comment, photograph, suggestion or other content to us, you confirm that you have the right to provide that content.
You must not submit content that is unlawful, defamatory, threatening, abusive, misleading, obscene or that infringes another person's intellectual property, privacy or other legal rights.
Where you deliberately submit content for publication, you grant us permission to display and use that content for the purposes reasonably associated with our Site and business, subject to applicable privacy and intellectual-property law.
11. Personal Information
Our collection and use of personal information is governed by our Privacy Policy.

12. Errors and Omissions
Occasionally our Site may contain typographical errors, incorrect pricing, inaccurate product information or other mistakes.
We may correct such errors and, where legally permitted, amend or cancel an affected order.
If we cancel an order after payment has been received, the appropriate refund will be issued.
Nothing in this section limits any rights you have under applicable consumer law.
13. Prohibited Uses
You must not use the Site or Services:
- for unlawful purposes;
- to infringe another person's intellectual property or legal rights;
- to transmit malicious software;
- to obtain unauthorised access to systems or accounts;
- to scrape, harvest or improperly collect personal information;
- to send spam or fraudulent communications;
- to impersonate another person;
- to interfere with the security or operation of the Site; or
- for any other unlawful or malicious activity.
We may restrict access to the Services where reasonably necessary to address prohibited conduct.
14. Consumer Guarantees and Warranties
Nothing in these Terms excludes or limits guarantees, warranties, rights or remedies that cannot legally be excluded.
For New Zealand consumers, this includes applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
For UK consumers, mandatory statutory consumer rights may also apply, including rights concerning goods that are not of the required quality, fit for their purpose or as described. UK consumer legislation restricts traders from contracting out of these statutory rights.
Our Returns & Refund Policy provides additional information about faulty products, returns, refunds and change-of-mind returns.
15. Limitation of Liability
To the maximum extent permitted by law, we are not responsible for losses that:
- were not reasonably foreseeable when the contract was formed;
- arise from misuse of our products;
- result from failure to follow reasonable care instructions; or
- arise from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits any statutory consumer rights or remedies that cannot legally be excluded or restricted.
16. Indemnity
You are responsible for losses reasonably arising from your unlawful use of our Site or a serious breach of these Terms.
Nothing in this section creates an obligation that would be unlawful or unfair under applicable consumer law.
17. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be interpreted or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
18. Termination
You may stop using our Services at any time.
We may suspend or terminate access to the Services where you seriously breach these Terms, misuse our Services or where suspension or termination is otherwise reasonably necessary.
Rights and obligations that arose before termination remain unaffected.
19. Entire Agreement
These Terms, together with the policies and information expressly incorporated into them, form the agreement governing your use of the Site and purchases from CALIBR.
Nothing in this section limits any statement, representation, guarantee or consumer right that applicable law prevents us from excluding.
20. Governing Law
Except where mandatory consumer law provides otherwise, these Terms and contracts formed through the Site are governed by the laws of New Zealand.
If you are a consumer in another country, including the United Kingdom, this choice of law does not deprive you of mandatory consumer protections that apply to your purchase and cannot legally be excluded.
UK distance-selling rules continue to provide cancellation and pre-contract information rights for ordinary distance contracts.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.
The current version will be published on the Site with an updated date where appropriate.
Changes do not retrospectively remove rights that have already arisen under an existing purchase or applicable law.
22. Intellectual Property and Trademarks
The CALIBR name, logos, branding, designs and other intellectual property displayed on the Site are owned by us or used with appropriate permission.
No licence to use our trademarks, logos, designs or branding is granted merely because they are displayed on the Site.
You must obtain our written permission before using CALIBR intellectual property except where use is otherwise permitted by law.
23. Website Content
Unless otherwise stated, the photographs, graphics, written material, product designs, videos and other original content appearing on the Site are owned by CALIBR or used with permission.
Unauthorised commercial reproduction or use is prohibited.
24. Prices, Currency and Payment
Prices are displayed in the currency shown on the Site or at checkout.
Where localised pricing is available, the currency displayed to you may depend on your location or selected market.
Any applicable taxes, duties, import charges or other costs will be dealt with as displayed during checkout or otherwise as required by applicable law.
We will not charge undisclosed mandatory fees where doing so would breach applicable consumer law.
25. Delivery
Delivery options, estimated delivery times and any applicable charges are shown on our Site or during checkout.
Where CALIBR advertises free standard delivery, no separate standard delivery charge is payable by the customer.
Our treatment of outbound shipping costs for voluntary change-of-mind returns is explained in our Returns & Refund Policy.
Nothing in this section limits statutory rights relating to cancellation, faulty goods or refunds.
26. UK Customers
CALIBR is operated from New Zealand but may offer and market products to customers in the United Kingdom.
UK consumers purchasing online may have statutory rights in addition to our own policies.
For eligible distance purchases, UK law generally provides a cancellation period for consumers. The Consumer Contracts Regulations remain applicable to ordinary distance contracts, while UK consumer legislation separately provides statutory product-quality and remedy rights.
Our Returns & Refund Policy explains these rights in more detail.
Nothing in these Terms is intended to waive or reduce any mandatory UK consumer protection that applies to you.
27. Promotions
Promotions, discount offers, competitions or giveaways may be subject to additional terms published with the relevant promotion.
We may modify or withdraw a promotion where reasonably necessary, subject to applicable law and any rights already acquired by participants.
Eligibility requirements, geographic restrictions and closing dates will be stated in the relevant promotional terms.
28. Handmade Products
Where a CALIBR product is handmade or individually finished, reasonable variations may occur between pieces, including variations in:
- design placement;
- engraving or texture depth;
- finish;
- colour;
- surface texture; and
- other characteristics resulting from the production process.
These variations can form part of the individual character of a handmade product.
This section does not permit a product to materially differ from its description and does not limit your statutory rights where an item is faulty or otherwise fails applicable consumer guarantees.
